Planning check — terms of use

These terms apply to every result produced by the LCCL planning check at lcclconstruction.co.uk/pd-check, to the result email it sends and to the saved-result link in that email. By ticking the box before your result is shown you confirm you have read and accept them.
The 14 terms.
1. The planning check is guidance, not a legal determination. It is our reading of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended, applied to the answers you give and to the government's open planning data for your postcode. Only the local planning authority can decide whether work is permitted development, through a Lawful Development Certificate, or grant planning permission or prior approval. The council has the final say.
2. The check works at postcode level. A postcode covers several properties; conservation areas, Article 4 directions, listed buildings, Green Belt and similar designations are read from national open data at the time of your check and can be incomplete, out of date or drawn to boundaries that differ from your property. We confirm the exact address, the designations and the history of the property before any drawings are submitted.
3. The result depends on your answers. If the house type, age, what has been built before or any other answer is wrong, the result will be wrong. Previous extensions, outbuildings and roof work count against permitted development allowances whether or not they were built by you.
4. Any figure shown is a from-price for an economy-level specification, design and build inclusive, based on typical LCCL projects of that type in your postcode area. It is not a quotation, offer or contract, creates no obligation on Loft Conversion Company London Limited (trading as LCCL Construction), and LCCL may decline to quote for or undertake any project. A fixed price is only given in a written proposal and contract following a consultation call, drawings and a survey, subject to LCCL's terms and conditions.
5. Where the result says an item is "priced at the survey", no figure has been given for it and no combined figure includes it.
6. Not included in any figure: floor coverings; kitchen and bathroom fittings and installation; structural openings and alterations to the existing house; planning, building control, Lawful Development Certificate and party wall fees; works to the existing house not described. Exclusions are not exhaustive.
7. Where the result says permitted development work "can start now", it means the work does not need a planning application on the information given. On every permitted development project LCCL applies for a Lawful Development Certificate so that the route is confirmed in writing by the council; the certificate, not this check, is the confirmation.
8. Where the result says an item needs planning permission or prior approval, the application may be refused or granted with conditions; the decision rests with the council, and fees, redesign and appeals following a refusal are extra.
9. The rules change. Each result shows the date the rules it uses were last reviewed and the date of the next scheduled review. Government, council and case-law changes between reviews are not reflected until the next review; a result is current only on the day it is produced.
10. Not a survey, valuation, legal or financial advice: do not rely on the check to decide whether to buy a property, to set an offer or budget, or in any mortgage, loan, insurance or valuation application, and do not start work on the strength of it. LCCL accepts no liability for decisions made in reliance on a planning check result.
11. For the personal use of the person who requested it, about a property they own or are buying; no third party may rely on it, and it is not for automated or commercial use.
12. LCCL builds in London, Hertfordshire, Buckinghamshire, Surrey, Kent and Essex. The rules the check applies are national (England), but figures and the consultation call are for properties in those areas; results elsewhere are indicative only and may not be followed by a quotation.
13. The check may contain errors or be unavailable; LCCL may correct or withdraw a result at any time.

Personal details you enter (name, email and, if you give it, a phone number) are handled under our privacy policy. The saved-result link in your email is private to you, lets anyone holding it see and change the answers, and is not indexed by search engines. Postcode lookups use the government's open planning data and are fetched live at the time of your check.
