A party wall agreement is a legal requirement under the Party Wall etc. Act 1996 when your building work involves a shared wall with a neighbour, building on or near the boundary line, or excavating within 3 to 6 metres of a neighbouring property. When Do You Need a Party Wall Agreement?
You need a party wall agreement when your project involves inserting steel beams or structural supports into a party wall, which is common in loft conversions. You also need one when cutting into a party wall for any reason, building a new wall on or up to the boundary line, excavating foundations within 3 metres of a neighbouring building or within 6 metres if the excavation goes below the bottom of the neighbours foundations. For loft conversions on terraced houses, you typically need party wall agreements with both neighbours. For semi-detached houses, you need one with the adjoining neighbour.
How the Party Wall Process Works
The process starts with serving a formal party wall notice to your neighbours, which must be done at least two months before building work that affects the party wall or one month for excavation work. Your neighbours then have 14 days to respond. If they consent in writing, no further action is needed. If they dissent or do not respond, both parties must appoint party wall surveyors to produce a party wall award. This award documents the condition of the neighbouring property before work starts and sets out the terms under which work can proceed. It protects both you and your neighbour.
How Much Does a Party Wall Agreement Cost?
If your neighbour consents to the party wall notice, the cost is minimal, typically just the surveyor fees for preparing the notice at around £200 to £400. If your neighbour dissents, you are responsible for paying both your own and your neighbours surveyor fees. This typically costs £1,100 to £1,800 per neighbour. For a mid-terrace property needing agreements with both sides, budget £2,200 to £3,600. The party wall process typically takes 4 to 8 weeks if a neighbour dissents.
